PICKLEBALL EVENT RELEASE AND WAIVER OF LIABILITY

PLEASE READ CAREFULLY — THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS

This Pickleball Event Release and Waiver of Liability (the “Release”) is entered into electronically by the individual submitting this form (the “Participant”), as of the date of electronic submission, in favor of Monmouth County Habitat for Humanity, Habitat for Humanity International, Inc., New Shrewsbury Racquet Club, and their respective directors, officers, trustees, employees, volunteers, members, sponsors, contractors, and agents (collectively, the “Released Parties”).

Participation in Event

I voluntarily choose to participate in a pickleball tournament and related activities organized by Monmouth County Habitat for Humanity and hosted at New Shrewsbury Racquet Club (the “Event”).

I understand that the Event may include, but is not limited to, pickleball matches, tournament play, warm-ups, clinics, open play, use of courts, nets, paddles, balls, seating areas, locker rooms, restrooms, walkways, common areas, parking areas, and travel to and from the Event.

Assumption of Risk

I understand that participation in pickleball and related activities involves inherent risks, including but not limited to:

• slips, trips, and falls
   

• collisions with other participants or spectators
   

• overexertion, muscle strains, sprains, or other physical injuries
   

• being struck by balls, paddles, or other equipment
   

• court surface conditions
   

• weather or environmental conditions
   

• equipment malfunction or misuse
   

• actions or omissions of other participants, spectators, or event staff
   

I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from or related to my participation in the Event.

Release and Waiver of Liability

To the fullest extent permitted by New Jersey law, I hereby release, waive, and forever discharge the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind arising out of or related to my participation in the Event, including travel to and from the Event, whether caused by the ordinary negligence of the Released Parties or otherwise, except to the extent caused by their gross negligence or intentional misconduct.

Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, demands, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to my participation in the Event or my breach of this Release.

Medical Treatment

I authorize the Released Parties to obtain emergency medical treatment for me if deemed necessary during the Event. I release the Released Parties from any liability arising from such medical treatment or the decision to seek or not seek treatment. I understand that I am solely responsible for all medical expenses incurred.

Insurance

I understand that the Released Parties do not provide health, accident, or liability insurance for participants. I am responsible for obtaining any insurance coverage I consider appropriate.

Minors

If the Participant is under the age of 18, a parent or legal guardian must complete this form. By submitting this form, the parent or legal guardian agrees to all terms of this Release on behalf of the minor Participant and themselves, to the fullest extent permitted by New Jersey law.

Photographic and Media Release

I grant the Released Parties the irrevocable right to photograph, record, or otherwise capture my name, image, likeness, and voice during the Event, and to use such materials for promotional, educational, fundraising, or other lawful purposes without compensation or further approval.

Governing Law

This Release shall be governed by and interpreted in accordance with the laws of the State of New Jersey. If any provision of this Release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Electronic Acknowledgment and Consent

By submitting this form electronically, I acknowledge and agree that:

• I have read and fully understand this Release;
   

• I understand that I am giving up substantial legal rights, including the right to sue the Released Parties;
   

• I am voluntarily agreeing to the terms of this Release;
   

• The information I provide is accurate and complete;
   

• I intend that my electronic submission, including my typed name, constitute my legal electronic signature; and
   

• This Release is binding upon me, my heirs, assigns, and legal representatives.
